Protect Your Loved Ones In A Will

If you don’t make a will, then who concludes who acquires what? Things may not proceed how you would have chosen. To be certain your desires are followed, you should to draw up a will.

If you die without without writing your last will and testament it’s the crown that decides how your estate is divided. The intestacy guidelines will be used and it could not be how you’d have hoped or wished.

If you are currently married or have a civil partner but no offspring and your estate is valued at a specific figure or under then your civil partner will get the entirety of the estate including any life insurance . If the property is valued above this amount and you have existing family, your spouse would still receive this figure, in addition to 50% of the remainder. There exists an order in which relatives will inherit, with existing parents being at the start of the list, followed by siblings and so on.

Should you have a spouse and children then your spouse would gain the set amount as above and 50% of the excess. The children would receive half of the amount over the set amount immediately and the other half on the death of your spouse.

If you have children but no legal partner, then your offspring would share the inheritance. This could not be at all what you would have wished. You might have a partner who relies on you and who you might have intended to inherit at least a proportion of your estate, who would get nothing.

To remove all possible worry about your assets, regardless of how simple it may appear, you should draw up a last will and testament. There are many ways to do this. You could make it yourself or use a trained will service or a solicitor.

Many people build their own will, generally using a template which you can buy from stationers. Take care if you go down this route – it’s surprisingly easy to make a mistake and you could even find it invalid. The price of having a will written, especially a relatively simple one, is not prohibitive and you can be confident that your wishes will be carried out.

A skilled will company or a solicitor will be used to handling all forms of enquiries and will be able to assist you. There could be queries about setting up trust funds and perhaps inheritance tax.
Now you’ve written your last will and testament, it’s a good decision to inspect it on occasion, as your situation changes. If you conclude to change it, then it’s a smart move to nullify your existing one and have it re-written. If the changes are minor, it might be more straight forward to draw up a codicil to form a section of the last will and testament and to be used in partnership with it. Any codicil will have to be made in the same way as the will in regards to signatures and witnesses.

Please be aware that any health insurance cover will terminate on the death of the will holder and no value will be attributed to It in the will.
